How to Search Calhoun County Arrest Records

Calhoun County is a mid-sized county in south-central Michigan. Marshall is the county seat and home to most county offices, but Battle Creek is the largest city. Because Battle Creek has its own police department, arrest records here come from several sources: the Sheriff's Office, the Battle Creek Police Department, and state-level systems. Knowing which agency holds what you're looking for matters before you start.

The statewide search tool for criminal history is ICHAT, run by Michigan State Police under MCL 28.241. A search costs $10 and covers all 83 counties. It's the fastest way to get a broad look at someone's record in Michigan. Access it at apps.michigan.gov. For Calhoun County-specific data, including arrest reports and booking information that may not appear in ICHAT, contact the Sheriff's Office or the relevant city police department directly.

The Calhoun County Justice Center in Battle Creek is where many county criminal proceedings take place. Courts and the jail both operate out of or near that facility. This is worth knowing when you're trying to figure out which records office to contact.

Calhoun County Sheriff's Office

The Calhoun County Sheriff's Office handles law enforcement for unincorporated areas of the county and runs the county jail. Their main office is in Marshall. They are a key source for arrest records outside of Battle Creek and other incorporated cities.

To get arrest or incident reports from the Sheriff's Office, file a FOIA request. Michigan's Freedom of Information Act, codified under MCL 15.231, requires agencies to respond within five business days. The Sheriff's Office can charge for copying costs and reasonable staff time. Requests can be submitted in writing, and the county website lists contact information for FOIA submissions. Most booking records, arrest logs, and incident reports are public unless they fall into an exempt category like an open investigation or a juvenile matter.

An arrest is not a conviction. Michigan law treats arrest records and conviction records differently. Just because a name appears in a booking log does not mean a conviction followed.

Calhoun County Jail and Inmate Records

The Calhoun County Jail is operated by the Sheriff's Office. It holds people arrested in the county who are waiting for court appearances or serving shorter sentences. The facility is near Battle Creek. To check whether someone is currently held there, call the Sheriff's Office at 269-781-0888.

For people who have moved from county jail to state prison, or who are under MDOC supervision on parole or probation, the right tool is OTIS. The Offender Tracking Information System is a free database at mdocweb.state.mi.us/otis2/otis2.html. It covers all people in MDOC custody or supervision, regardless of which county their case originated in. County jail inmates are not in OTIS, only state-level offenders.

The OTIS search interface makes it straightforward to find Michigan prisoners and people on supervision. The screenshot below shows what the tool looks like when you access it online.

If you need actual documents from a case, contact the Calhoun County Circuit Court Clerk in Marshall. The clerk's office maintains the official paper and electronic case files. For district court records, contact the appropriate district court office in the city or township where the case was filed.

ICHAT Criminal History for Calhoun County

ICHAT is Michigan's statewide criminal history database. It is run by Michigan State Police and authorized by MCL 28.241. Each search costs $10 and returns conviction records from all 83 counties. For Calhoun County searches, ICHAT is especially useful because Battle Creek generates a relatively high volume of criminal cases compared to smaller counties, and records may span other counties as well.

To use ICHAT, go to apps.michigan.gov and select the criminal history search option. Pay by credit card. Results come back quickly. The system shows felony and misdemeanor convictions. It does not always include arrests that did not lead to conviction. Cases that were dismissed, resulted in acquittal, or were set aside under Clean Slate may not appear.

ICHAT gives you the broad picture. For case-level detail, follow up with the court clerk or the Sheriff's Office after reviewing ICHAT results.

FOIA Requests in Calhoun County

Michigan's FOIA law, MCL 15.231, gives the public a right to request records from any government agency in Calhoun County. This includes the Sheriff's Office, Battle Creek Police Department, Marshall Police Department, the county clerk, and other local offices. Each agency handles its own FOIA submissions.

Written requests go directly to the agency that holds the records you want. They have five business days to respond. If a request will cost more than $50 to fill, the agency must provide a written estimate. You have the right to appeal a denial, first to the agency head and then through the circuit court if needed. Fees must be reasonable and broken down by category.

Michigan State Police has a separate FOIA portal for MSP-generated records. That's at michigan.gov/msp/services/foia. State troopers patrol parts of Calhoun County, so some incident records may be held by MSP rather than a local agency.

The MSP FOIA portal is shown below. This is where requests for state police records begin, separate from any local agency submission.

Always submit your request to the correct agency to avoid delays. If you're not sure who holds a record, start by calling the agency most likely involved and asking before you file.

Clean Slate Expungement in Michigan

Michigan's Clean Slate law, found under MCL 780.621g, allows automatic set-asides for many convictions once enough time has passed. Most misdemeanors become eligible after seven years. Certain felonies qualify after ten years. No petition is required for eligible convictions. The set-aside happens automatically through the court system.

Not all convictions qualify. Serious violent felonies, crimes against children, and certain traffic offenses are excluded. When a conviction is set aside, it typically drops out of ICHAT results. This matters if you're doing a Calhoun County background search and the results look cleaner than expected. It doesn't always mean the person has no history. It may mean an older record was automatically cleared.

Manual petitions for expungement are still available for those who want to pursue set-aside before the automatic window opens. Circuit courts handle those petitions. A local attorney in Battle Creek or Marshall can help assess eligibility for a specific conviction.

Michigan Sex Offender Registry for Calhoun County

Michigan's Sex Offender Registry is public and searchable by location, including Calhoun County addresses. The registry is maintained under MCL 28.721 by Michigan State Police. You can search by name or by area at mspsor.com. Profiles show current address, photo, offense details, and registration tier level.

Given that Battle Creek is the largest city in Calhoun County, there are more registered offenders here than in smaller rural counties. Searching by zip code can help narrow results to a specific part of the county. The advanced search at mspsor.com/Home/Search provides more filter options.
